The election is over, but there is a question about whether Donald Trump is legally competent to stand trial in a criminal case. This may be an issue in the future if a judge asks for a psychiatric exam due to Trump's erratic behavior.
In New York, where he may be indicted, this appears to be the standard:
"Incapacitated person" means a defendant who as a result of mental disease or defect lacks capacity to understand the proceedings against him or to assist in his own defense, http://ypdcrime.com/cpl/article730.htm
I think Trump meets this standard. His mental disease or defect is his delusional thinking and severe narcissistic personality disorder. He can't understand the proceedings because he does not think that he can do anything wrong. He cannot assist in his defense because he cannot tell the truth consistently, cannot differentiate right from wrong, cannot separate his delusions from reality and cannot conform his conduct to the law, at least most of the time.
He probably does NOT meet the standard for involuntary hospitalization because although he is a threat to others as President through neglect of office, he does not present a threat to do physical harm, the standard in Michigan, https://www.treatmentadvocacycenter.org/browse-by-state/michigan. Of course, he would probably be assessed using the laws of Florida, his new residence, but the standards appear to be similar.
